LocalMakaan acts as a technology platform for publishing and discovering property-related information. Unless expressly stated otherwise, LocalMakaan is not the owner, developer, broker, builder, financial institution or legal representative of the properties listed on the Platform.

2. Acceptance of Terms

By accessing or using LocalMakaan, you confirm that:

  • You are legally capable of entering into a binding agreement.

  • You agree to comply with all applicable laws and regulations.

  • You will use the Platform only for lawful purposes.

  • You will provide accurate and truthful information whenever requested.

  • You understand that continued use of the Platform constitutes acceptance of these Terms and any future updates.

3. Definitions

All listings submitted to the Platform must accurately represent the property being advertised. Users are solely responsible for the content they publish.

LocalMakaan reserves the right to review, edit, reject, suspend or remove any listing that violates these Terms or applicable laws.

10. Listing Requirements

Every property listing published on LocalMakaan must comply with the following requirements:

  • The property information must be accurate and complete.

  • The listing must describe a genuine property available for sale, rent or lease.

  • Images should represent the actual property wherever possible.

  • Prices should be displayed honestly and updated when changed.

11. Buying Property

LocalMakaan is not a party to rental agreements and assumes no responsibility for disputes between landlords and tenants.

14. Real Estate Agents, Builders and Developers

Licensed real estate agents, builders and developers may use LocalMakaan to advertise projects and properties.

Such users agree that they:

Every user of LocalMakaan agrees to use the Platform responsibly and in good faith.

Users shall:

Removal of a listing does not prevent LocalMakaan from taking additional action where necessary.

19. Transactions Between Users

All negotiations, agreements and transactions conducted through LocalMakaan occur directly between users.

LocalMakaan:

  • Is not a buyer or seller.

  • Is not a landlord or tenant.

  • Is not a real estate broker unless expressly stated.

  • Does not guarantee the completion of transactions.

  • Does not guarantee payment or delivery.

  • Does not provide legal representation.

Users are solely responsible for conducting due diligence and completing transactions in accordance with applicable laws.

20. Independent Verification

Users should independently verify all information before making any financial or legal commitment.

This includes verification of:

  • Impersonate another person, company or organization.

  • Upload viruses, malware or other harmful software.

  • Attempt to gain unauthorized access to the Platform or user accounts.

  • Interfere with the operation or security of the Platform.

  • Harvest, collect or misuse personal information belonging to other users.

  • Use automated software, bots or scraping tools to extract data without written permission.

  • Post offensive, defamatory, abusive, discriminatory or illegal content.

  • Misrepresent property ownership, pricing, approvals or legal status.

  • Circumvent security measures or technical protections implemented by LocalMakaan.

Any violation of these provisions may result in suspension or permanent termination of access to the Platform and may also lead to legal action where appropriate.

22. Intellectual Property Rights

All intellectual property rights relating to the Platform are owned by or licensed to LocalMakaan unless otherwise stated.

This includes, but is not limited to:

  • Software

  • Source code

  • Graphics

  • Logos

  • Icons

  • Databases

  • Text content

  • Images created by LocalMakaan

Nothing contained in these Terms grants any ownership rights to users.

23. Limited License

This license continues only for as long as reasonably necessary to operate the Platform or until the content is removed, subject to legal and operational requirements.

27. Advertising and Promotional Content

LocalMakaan may display advertisements, promotional materials or sponsored property listings.

Sponsored or promoted content may be identified separately from standard property listings where appropriate.

The presence of advertising does not constitute a recommendation, guarantee or endorsement by LocalMakaan.

Users are responsible for independently evaluating any advertised products or services before making purchasing decisions.

  • we consider in our absolute discretion to be prejudicial to the proper performance of the service; or

By using the service, Users assume the full and exclusive responsibility for their behavior towards the Site and towards third parties including but not limited to other Users.

We are not responsible for and do not guarantee the veracity of the contents of any advertisements placed by Offeror Users, or the successful outcome of any negotiations between any Offeror User(s) and any Recipient User(s).

Limitation of Liability

Nothing in these Terms of Use applies to limit or exclude any liability of any party for death or personal injury caused by that person's negligence or any person for whom they are responsible, or for fraud, or for any other liability which may not be excluded or limited by law.

The Site and its affiliates, and its or their affiliates, managers, employees, officers or directors do not accept any liability for:

  • any loss or damage to the extent it arises from circumstances outside their reasonable control;
  • any loss or damage caused by any interruption in or non-availability of the Site or the service;
  • any direct or indirect loss of profits, business, reputation, anticipated savings or turnover;
  • any loss or corruption of data;

By creating an online profile or placing an advertisement on the Site, Offeror Users confirm they are of legal age in the relevant jurisdiction, that they are the person identified in that profile and that they have not been coerced in any way.

An advertisement published by an Offeror User shall not in any manner be a violation of the applicable laws and regulations of the jurisdiction/country of residence of the Offeror User. In the event of a breach of these terms, or a violation of the applicable laws and regulations, we reserve the right to take down the advertisement without refund, to delete any applicable profile and to ban Users from creating any future profiles or placing any future advertisements.

Acceptable Use Policy

Users undertake not to use the service provided by the Site either improperly or contrary to the provisions of applicable law, regulation, rules of ethics and good conduct of the network services. Users, in particular, undertake not to transmit through the Site material of offensive and libellous nature, discriminatory, harassing, defamatory, pornographic, paedophile, vulgar, blasphemous or which is in some way contrary to the principles of public order and good morals.

Offeror Users are responsible for complying with all applicable laws with respect to the content of their advertisement. In particular, Users must not advertise any services or publish any data/content which it is unlawful to perform/publish within their jurisdiction.

Offeror Users warrant that they are the data subjects of or that they have the explicit and informed consent of all persons whose personal data is included in any advertisement placed by them and that they will not use any material in their advertisements which contravenes the copyright or other intellectual property rights of any third person without having the permission of that third person.

Offeror Users are aware that by including an email address in advertisements hosted by the Site, we have no control over any materials which may be sent directly to that email address, whether by other Users or otherwise, and whether in answer to that advertisement.

Offeror Users have their specific attention drawn to the following summary of the above Terms of Use. For the avoidance of doubt, we offer this summary as a convenience to our Users and it should not be taken to constitute legal advice as to when material is lawful to include in advertisements and profiles.

  • Advertisements that contain references to sexual services in exchange for money are not allowed;

  • It is permitted to publish the same advertisement in a maximum of three different cities;
  • It is not permitted to repeat the same advertisement in the same city during the same time period; and
  • It is not permitted to include hypertext links in any advertisement or profile.

As a general rule, no refund will be provided by the LocalMakaan.com company for buyer. Suggestion for buyer please visit physically on advertiser property and verify if buyer satisfy to advertiser then can pay amount to property advertisers.
